Because we are all presumed innocent, everyone that has ever been arrested has been suspected of something. A lot of people voluntarily go in for questioning to avoid being arrested. Some argue and fight, leading to an arrest. Some are deemed a danger to others and arrested.

You can be arrested for simply resisting arrest with no supportive charges.

Have you ever been arrested?

by Rude-Marketing9402 1 month ago

Nope. I've broken plenty of laws in my time, but I've never been dumb enough to do something and get caught.

Oh we got a badass over here

They literally say as you're bing arrested. You are being arrested under suspicion of. I've been arrested for stuff I didn't even do. Get off that high horse pal

That's just a legal term for being detained prior to conviction in a court of law. How would you arrange the justice system such that defendants can only be arrested after their conviction?

by veumleopold 1 month ago

Ok? So what? They may also not say "under suspicion of" and just say "you're under arrest for..." In the US you need probable cause to arrest someone, and that's a legal standard.

Been arrested multiple times never told I was under arrest for suspicion of something. It's always "you're under arrest for xyx"

They literally say as you're bing arrested LMFAO no, they literally don't. They typically don't say anything other than saying you're under arrest. They don't have to tell you why you're under arrest and most cops are trained not to say why. The only things cops have to say is your miranda rights, but even then, they don't have to read you your miranda rights until you are questioned. So if they don't plan to question you until you're back at the precinct, they don't have to say a damn thing to you until they start questioning you.

Where I am in the world. Let's remember not everyone is a yank. They do indeed tell you what you're under arrest for and tell you while reading you your rights.

So you want court cases to be concluded before arrests? Good luck

Probable cause is required for a lawful arrest. Reasonable suspicion warrants further investigation/temporary detainment

Tell me you don't understand RAS and PC without telling me

But they're generally not arrested purely on the suspicion sure, that's the wording, but it's not to the police to decide whether you're guilty of what they're arresting you for. That's up to the courts and a jury. That, as I understand it is the reason they say it's a suspicion. Further, an arrest, in my admittedly limited understanding, is simply a mechanism to allow the police to investigate the particulars of whether you have committed a crime safe in the knowledge that if they need to find you again, they can do so relatively easily. So, for example, if you refuse to provide identification to a constable that asks you to identify yourself to them, they may arrest you while they investigate your identity. Yes, in the UK you are required by law to identify yourself to a member of the police when asked to do so.
