That's not necessarily the same thing. Stealing from walmart is literally taking something that doesn't belong to you or taking something you don't own. If you walk into a restaurant and you are being served you are literally being given things.

With restaurants, they're providing a service and giving you the food at the same time, without a clear point where you officially "agree" to pay. If you walk into a restaurant and you are being served you are literally being given things. Okay, so let's go with this... I walk place an order with an optometrist. They prepare my glasses to my prescription. I walk out of the door with the glasses and without paying. They gave them to me, after all. I go to a grocery store and get some sliced meat and cheese. They hand me these things. I walk out the door without paying. Like, even as a troll premise, the idea falls flat at the first hurdle (a veneer of plausibility) because almost every business has an aspect where one thing is handed over without an explicit contract. And that's not even looking at the other side: I go into a business and order something. Their card reader is behind the counter, so I hand them my card. They now own my bank account, it was a gift. Heartbroken, I go somewhere else and pay cash. They keep the change. It's their change. They keep all the change.

Apparently you don't understand how offer and acceptance works. You make an offer to the restaurant when you make the order. The restaurant accepts the offer when the staff confirms the order. The contract is made then. What you do with the food when it arrives, is irrelevant. You owe. The restaurant fulfills their contractual obligations by preparing and serving the food and you fulfill yours by paying for it. If you don't, you are in breach of contract. It's not "an unspoken contract". It's literally a contract.

If you order something verbally, that's an agreement. You can walk in and out all you want, provided they let you, on their private property, without paying. But if you order anything, you need to adhere to your agreement.

You pretty much can. As lone as you did not order anything. Once you order something you have agreed to pay for it. It is like saying If I invite someone to eat in my restaurant I should be able to harvest one of their kidneys.. It is not my fault they did not read the fine print on the 37 page document they signed.

It's called a implied contract. There are many types of contracts, not just those in writing. Contracts can be implied through actions, conduct, or verbal agreements, and they can be legally binding even without a formal written document. I once had to discuss this with an customer.... For example, when you order food at a restaurant, you implicitly agree to pay, even though there's no formal contract. In many countries, including America, these contracts are legally binding, and you can even work without a signed document, as long as the terms (like work and payment) are understood through actions a <- mostly used at "at-will" employment situations. You don't always need a pen and paper to make a contract.
