The definition of "victim" would then get litigated to oblivion. No thanks. Doing this would also lead to rises in actual crimes because the threshold on punishment would be much lower.

Lots of cases where this just doesn't work. Attempted murder no longer a crime. No harm no foul. "Consensual" sex with a minor. Who's to say there's a victim Speeding/DUI/all workplace safety rules. Engaging in risky behaviors that put others at risk is fine until you actually kill someone.
